I, , acting as representative of (hereafter “the Garden”) agree to the conditions of Syracuse Grows:
That the Garden and all of its members and volunteers shall save and hold harmless Syracuse Grows, its officers, volunteers, employees, agents, successors and assigns from any and all personal injuries, property damage, losses, suits, costs (including reasonable attorney’s fees), claims, damages, expenses, judgments, liabilities or liens, arising directly or indirectly from the garden’s participation in the Syracuse Grows Program (hereafter “the Program”) during the term stated herein or any renewal thereof, from the conduct of management of the Garden in the Program or the Garden’s participation therein, from the parties’ activities under this Agreement, or from any landscaping, gardening, planting, preparation or other work or labor performed at the Garden caused to be performed by the participant unless the above mentioned injuries, damages or losses result from the willful acts of or wanton conduct of Syracuse Grows.
The Garden further understands that its participation in the Program is voluntary and conducted in concert with the rules and regulations of Syracuse Grows and failure to follow the terms contained herein shall result in the Garden's immediate dismissal from the Program. On behalf of the Garden, I hereby waive any and all claims and causes of action resulting from my failure to follow the rules and procedures governing the Program.
